Terms of Service

By creating an account, accessing, or using KOTH, you acknowledge that you have read and agree to these Terms of Service, the Privacy Policy, and the Official Challenge Rules.

1. Eligibility

You must be at least 13 years old to create an account or use KOTH.

If you are between 13 and 17 years old, you represent that you have permission from a parent or legal guardian to use KOTH, submit videos, participate in challenges, and receive any prize for which you may be eligible.

KOTH may request reasonable information to verify a user's age, identity, eligibility, or parental permission before awarding a prize or continuing to provide access to the service.

2. Accounts

You are responsible for providing accurate account information and maintaining the confidentiality of your login credentials.

You may not create an account using false information, impersonate another person, share an account, or create multiple accounts to gain an unfair advantage.

You are responsible for activity occurring through your account. Notify KOTH promptly if you believe your account has been accessed without permission.

3. Your Content

You retain ownership of videos, profile photos, comments, and other content you submit to KOTH.

You represent that you own your submitted content or have all rights, permissions, and consents necessary to submit and display it through KOTH. You may not submit content that infringes another person's copyright, trademark, privacy, publicity, or other rights.

You should not record or submit a video containing another identifiable person unless you have that person's permission. If the person is a minor, you must have permission from the minor's parent or legal guardian.

By submitting content, you grant KOTH a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transcode, technically format, display, distribute, and make your content available within KOTH for the purposes of operating, moderating, promoting, and improving the service and administering competitions.

This license continues for as long as reasonably necessary to operate KOTH, maintain backups, document competition results, resolve disputes, enforce agreements, or comply with applicable law.

4. Recording and Submission Integrity

Challenge submissions must be captured live using the in-app camera unless the applicable challenge expressly states otherwise.

Pre-recorded, edited, artificially generated, digitally manipulated, misleading, staged, or otherwise fraudulent challenge submissions are prohibited.

KOTH may remove, reject, adjust, investigate, or disqualify any submission that appears inaccurate, manipulated, unsafe, unverifiable, misleading, or inconsistent with the applicable challenge requirements.

5. User Conduct

You agree not to:

• Cheat, manipulate results, misreport a value, or interfere with competition integrity.
• Use multiple accounts, bots, scripts, automated systems, exploits, or unauthorized software to gain an advantage.
• Impersonate, threaten, harass, bully, abuse, stalk, or defraud another person.
• Submit unlawful, hateful, sexually explicit, excessively violent, threatening, defamatory, or otherwise harmful content.
• Submit content depicting illegal conduct, weapons, controlled substances, or activity that creates an unreasonable risk of injury.
• Attempt to access another user's account or interfere with KOTH's systems, security, or operation.
• Collect, publish, or misuse another user's personal information.
• Use KOTH for unauthorized commercial activity, gambling, wagering, or any unlawful purpose.

6. Physical Safety

Some KOTH challenges involve exercise, balance, endurance, coordination, athletic activity, or other physical activity.

Participation is voluntary. You are responsible for evaluating your health, physical ability, surroundings, equipment, supervision, weather, surface conditions, and other relevant circumstances before attempting a challenge.

Do not attempt a challenge if you are injured, impaired, medically restricted, unfamiliar with the activity, unable to perform it safely, or located in an unsafe environment.

Never attempt a challenge while driving, near traffic, near an unprotected height, in or near dangerous water, around unsafe equipment, or in any location where participation could endanger you or another person.

Stop immediately if you experience pain, dizziness, shortness of breath, weakness, loss of balance, or any other warning sign.

Nothing in KOTH constitutes medical, health, fitness, athletic, or professional advice. Consult a qualified medical professional when appropriate.

7. Assumption of Risk

Physical activities can involve inherent and unforeseen risks, including falls, collisions, strains, fractures, illness, property damage, serious injury, disability, or death.

To the fullest extent permitted by law, you voluntarily assume the risks arising from your decision to attempt or participate in any challenge.

A parent or legal guardian who permits a minor to use KOTH acknowledges the risks associated with the minor's participation and is responsible for deciding whether supervision or other precautions are appropriate.

8. Challenges and Prizes

Participation in KOTH challenges is also governed by the Official Challenge Rules below, which are incorporated into these Terms.

KOTH challenges offering prizes are intended to be skill-based competitions. No purchase or payment is required to enter or win.

KOTH may verify submissions, correct reported values, resolve ties, determine eligibility, disqualify participants, withhold or revoke prizes, and modify, suspend, or cancel challenges as provided in the Official Challenge Rules.

9. Moderation and Enforcement

KOTH may review, restrict, remove, preserve, or disclose content when reasonably necessary to operate the service, enforce these Terms, protect users, investigate misconduct, comply with law, or respond to a valid legal request.

KOTH may warn, restrict, suspend, or permanently terminate an account that violates these Terms, the Official Challenge Rules, community standards, applicable law, or the integrity or safety of the service.

KOTH is not required to monitor every submission, post, comment, or interaction and cannot guarantee that all inappropriate content will be identified or removed immediately.

10. Reports and Complaints

Users may report inappropriate content, suspected cheating, safety concerns, intellectual-property violations, or other misconduct by contacting support@playkoth.app .

Reports should contain enough information for KOTH to identify and evaluate the reported material or conduct.

11. Intellectual Property

KOTH's software, design, features, graphics, logos, branding, text, and other service materials, excluding user content, are owned by or licensed to KOTH and are protected by applicable intellectual-property laws.

You may not copy, reverse engineer, modify, distribute, sell, sublicense, or create derivative works from KOTH except as expressly permitted by applicable law.

12. Third-Party Services

KOTH may depend on third-party hosting, storage, authentication, analytics, notification, communication, payment, or infrastructure providers.

Your use of certain third-party services may also be governed by those providers' separate terms and privacy policies.

13. Availability and Changes to the Service

KOTH may add, remove, suspend, modify, or discontinue features at any time.

Access may occasionally be interrupted because of maintenance, technical failures, security concerns, legal requirements, or events outside KOTH's reasonable control.

KOTH does not guarantee that the app, any challenge, or any particular feature will always be available, uninterrupted, secure, or error-free.

14. Disclaimer of Warranties

To the fullest extent permitted by law, KOTH is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.

KOTH does not guarantee the accuracy of user submissions, leaderboard information, comments, reported values, availability, or competition outcomes.

15. Limitation of Liability

To the fullest extent permitted by law, KOTH and its owners, operators, administrators, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from or related to KOTH.

To the fullest extent permitted by law, KOTH is not responsible for injury, illness, death, property damage, loss, or other harm resulting from a user's decision to attempt a challenge, disregard safety instructions, misuse the service, or rely on content submitted by another user.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

16. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless KOTH and its owners, operators, administrators, contractors, service providers, and affiliates from claims, liabilities, damages, losses, and reasonable costs arising from your content, your conduct, your misuse of the service, your violation of these Terms, or your violation of another person's rights.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any dispute arising from or relating to KOTH or these Terms will be subject to the jurisdiction of the state and federal courts located in California, unless applicable law requires otherwise.

Before filing a formal legal claim, you agree to contact KOTH at support@playkoth.app and make a good-faith effort to resolve the dispute informally.

18. Changes to These Terms

KOTH may update these Terms from time to time. When material changes are made, KOTH may provide notice through the app, the website, email, or another reasonable method.

The updated Terms will state a revised Last Updated date. Continued use of KOTH after revised Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law.

19. Severability and No Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

KOTH's failure to enforce a provision does not waive its right to enforce that provision later.

20. Entire Agreement

These Terms, the Privacy Policy, the Official Challenge Rules, and any challenge-specific instructions presented in KOTH form the agreement governing your use of KOTH.

Privacy Policy

This Privacy Policy explains what information KOTH collects, how that information is used and shared, and the choices available to users.

1. Information We Collect

Depending on how you use KOTH, we may collect the following categories of information:

• Account information, such as your username, display name, email address, date of birth, and age or parental-permission acknowledgment.
• Authentication information. Passwords are processed using secure authentication methods and are not intended to be stored in readable plaintext.
• Optional profile information, including a profile photograph.
• Videos, comments, likes, challenge entries, reported measurements, rankings, and other content you submit.
• Social information, such as friend requests, friendships, followers, or interactions with other users.
• Notification information, such as challenge announcements, deadline reminders, likes, comments, friend requests, verification results, and ranking changes.
• Support communications and other information you voluntarily provide when contacting KOTH.
• Technical and usage information that may be automatically generated when you use the app, such as device type, operating-system version, IP address, app activity, crash information, diagnostic information, and approximate access times.

2. How We Use Information

KOTH may use information to:

• Create, authenticate, and maintain accounts.
• Operate weekly challenges and leaderboards.
• Review and verify challenge submissions.
• Correct or confirm reported measurements.
• Determine rankings and prize eligibility.
• Deliver prizes and contact winners.
• Provide social features and activity feeds.
• Send service and competition notifications.
• Moderate content and enforce app rules.
• Detect fraud, cheating, abuse, and security threats.
• Respond to support requests and disputes.
• Maintain, analyze, secure, and improve KOTH.
• Comply with legal obligations and valid requests.

3. Videos and User Content

Challenge videos and social posts are stored using KOTH's service providers and may be reviewed by authorized administrators.

Signed-in users may be able to view leaderboard videos, profile information, reported values, comments, likes, and rankings.

Friends may be able to view videos and other activity shared through the friends feed.

Although storage systems may restrict direct public access, content displayed within the app should not be considered private if other users are permitted to view it.

4. Information Visible to Other Users

Depending on your activity and app settings, the following information may be visible to other signed-in users:

• Username and display name.
• Profile photograph.
• Challenge submissions and videos.
• Reported or verified performance values.
• Leaderboard position and challenge history.
• Comments, likes, friendships, and social activity.

Your date of birth, password, and private authentication information are not displayed on public leaderboards.

5. How Information May Be Shared

KOTH may share information:

• With other users as necessary to provide profiles, leaderboards, videos, comments, social feeds, and other app features.
• With service providers that assist with cloud hosting, data storage, authentication, notifications, analytics, security, support, communications, or prize administration.
• When reasonably necessary to investigate fraud, cheating, abuse, safety threats, or violations of these policies.
• When required by law, legal process, court order, or a valid government request.
• To protect the rights, safety, property, or security of KOTH, its users, or others.
• In connection with a merger, financing, acquisition, sale, restructuring, or transfer of all or part of the KOTH business or assets, subject to applicable law.

KOTH does not sell personal information in exchange for money.

6. Prizes and Winner Verification

KOTH may request information reasonably necessary to confirm a winner's identity, age, eligibility, parental permission, contact information, or payment information.

Prize information may be shared with payment providers or other service providers as necessary to deliver a prize, document payment, prevent fraud, or comply with legal and tax obligations.

7. Data Retention

KOTH retains information for as long as reasonably necessary to provide the service, administer competitions, maintain security, prevent fraud, resolve disputes, comply with legal obligations, and enforce its agreements.

Some information may remain temporarily in backups or may be retained when necessary to document prize payments, competition results, moderation actions, fraud investigations, legal compliance, or disputes.

8. Account and Data Deletion

Users may request deletion through any available in-app account-deletion feature or by contacting:

Deleting an account generally removes or deidentifies the user's profile, submissions, friendships, notifications, and related account information, subject to reasonable processing time and legal or operational retention requirements.

Content already shared with or copied by other users may not be fully retrievable or removable from those users' possession.

9. Children's Privacy

KOTH is not intended for children under 13, and users under 13 are not permitted to create an account.

If KOTH learns that it collected personal information from a child under 13 without legally sufficient authorization, it may suspend the account and delete the information as required by applicable law.

10. Data Security

KOTH uses reasonable administrative, technical, and organizational measures intended to protect user information.

However, no storage system, network, transmission, or online service can guarantee absolute security. Users should maintain secure passwords and protect access to their devices and accounts.

11. Your Choices

Depending on available app features, users may be able to:

• Update profile and account information.
• Choose whether to upload an optional profile photo.
• Manage certain notification settings.
• Delete content or request account deletion.
• Contact KOTH regarding privacy questions.

12. State Privacy Rights

Residents of certain states may have rights concerning access, correction, deletion, or disclosure of personal information, subject to applicable legal exceptions.

Requests may be submitted to support@playkoth.app . KOTH may take reasonable steps to verify the requester's identity before completing a request.

13. External Links and Services

KOTH may contain links to external websites, payment services, or third-party services. Their privacy practices are governed by their own policies, not this Privacy Policy.

14. Changes to This Privacy Policy

KOTH may update this Privacy Policy as its practices, services, or legal obligations change.

Material updates may be communicated through the app, website, email, or another reasonable method. The Last Updated date will identify the current version.

Official Challenge Rules

No purchase or payment is necessary to enter or win. KOTH challenges are skill-based competitions. A purchase will not improve a participant's chance of winning.

1. Sponsor and Administrator

KOTH challenges are sponsored and administered by the developer and operator of KOTH, referred to in these rules as "KOTH."

Apple Inc. is not a sponsor of, responsible for, or involved in KOTH challenges, competitions, prizes, judging, administration, or winner selection in any manner.

2. Agreement to the Rules

By entering a KOTH challenge, you agree to these Official Challenge Rules, the Terms of Service, the Privacy Policy, and any instructions or criteria displayed for that particular challenge.

If challenge-specific instructions conflict with these general rules, the challenge-specific instructions will control for that challenge, except where prohibited by law.

3. Eligibility

You must be at least 13 years old and have a valid KOTH account to participate.

If you are between 13 and 17 years old, you represent that you have permission from a parent or legal guardian to use KOTH, submit videos, participate in challenges, and receive a cash, gift-card, or other prize.

A winner may be required to provide reasonable proof of identity, age, eligibility, parental permission, or compliance with these rules before receiving a prize.

Challenges are void where prohibited or restricted by law. KOTH may exclude a participant or location when reasonably necessary to comply with applicable law.

4. Challenge Period

Challenges generally begin Monday at 10:00 a.m. local time and close the following Sunday at 5:00 p.m. local time.

Exact start times, deadlines, prize information, judging criteria, and challenge requirements may vary. The in-app countdown and challenge page control for the active challenge.

KOTH's systems and records are the official timekeeping method for determining whether an entry was timely received.

5. How to Enter

To enter, an eligible user must complete the applicable challenge, record the attempt through the in-app camera, provide any requested measurement or information, and submit the entry before the deadline.

No purchase, payment, subscription, or entry fee is required.

6. Number of Attempts

Unless the challenge states otherwise, users may record and submit multiple attempts before the deadline.

Only the user's most recent eligible submission will count toward the final leaderboard position, even if an earlier submission had a better reported result.

7. Recording Requirements

Every challenge submission must be recorded live through the in-app camera unless the challenge expressly permits another method.

Camera-roll uploads, pre-recorded videos, spliced footage, altered playback speed, hidden cuts, misleading camera angles, artificial intelligence-generated content, and other manipulated submissions are prohibited.

Videos must clearly show enough of the attempt for KOTH to assess compliance, safety, timing, form, repetitions, distance, or other applicable criteria.

8. Submission Requirements

Entries must:

• Accurately depict the participant's attempt.
• Comply with the challenge instructions.
• Contain an accurate self-reported value.
• Be submitted through the participant's own account.
• Be captured before the challenge deadline.
• Comply with applicable law and these rules.
• Avoid infringing another person's intellectual property, privacy, or publicity rights.
• Avoid exposing private information or depicting another person without appropriate permission.

9. Skill-Based Winner Determination

Winners are determined based on skill and the criteria described for the applicable challenge, such as verified time, repetitions, distance, accuracy, form, performance, or another objective or stated skill measure.

Winners are not determined by random selection, chance, wagering, or payment.

Community activity, comments, likes, or voting will not determine a winner unless a challenge specifically states that community evaluation is an announced judging criterion.

10. Verification and Administration

Leaderboard positions may initially reflect values reported by users and remain provisional until verification is complete.

KOTH administrators may review videos, compare reported values with recorded performance, correct measurements, request additional information, flag entries for follow-up, and disqualify entries.

KOTH may delay final results while investigating suspected cheating, technical errors, duplicate accounts, safety issues, eligibility questions, or other concerns affecting competition integrity.

11. Ties

If two or more eligible submissions have the same verified result, KOTH may resolve the tie by:

• Conducting a closer review of the videos.
• Applying an announced secondary skill-based criterion.
• Considering greater precision in the verified measurement, where available.
• Declaring a shared position.
• Dividing the applicable prize evenly.

KOTH will not use a random drawing to resolve a tie in a skill-based challenge.

12. Prizes

The prize amount or description for a challenge will be displayed in the app before that challenge closes.

Prizes may differ between challenges. A prize has no cash equivalent unless KOTH expressly states otherwise.

Prizes are not transferable except at KOTH's discretion and may not be substituted by a winner. KOTH may substitute a prize of equal or greater value when the advertised prize becomes unavailable for reasons outside KOTH's reasonable control.

13. Winner Notification and Prize Claims

Potential winners may be contacted through the app, activity feed, push notification, email, or other contact information associated with their account.

A potential winner may be required to respond, confirm payment details, verify eligibility, obtain parental permission, or complete other reasonable verification steps within the period specified by KOTH.

Unless KOTH provides a different deadline, a winner must respond to a prize notification within 14 calendar days.

If a potential winner does not respond, cannot be contacted, provides inaccurate information, fails verification, declines the prize, or violates these rules, KOTH may revoke the prize and award it to the next eligible participant.

14. Prize Delivery

Prizes are paid or delivered manually outside the app within a reasonable period after results are finalized and the winner completes any required verification.

Delivery time may depend on the winner's response, payment method, identity verification, fraud review, parental permission, service-provider availability, and other reasonable administrative requirements.

KOTH will maintain reasonable records of finalized rankings and prize delivery.

15. Taxes and Expenses

Winners are responsible for taxes, fees, and expenses associated with accepting or using a prize, except where applicable law requires otherwise.

KOTH may request tax or identification information and may issue tax documentation when required by law.

16. Disqualification

KOTH may remove an entry, suspend an account, revoke a ranking, or withhold or recover a prize if KOTH reasonably determines that a participant:

• Submitted false or misleading information.
• Manipulated or edited a submission.
• Used a pre-recorded video.
• Misreported a performance value.
• Used multiple accounts or another person's account.
• Interfered with another participant.
• Used bots, exploits, or unauthorized software.
• Attempted to influence an administrator improperly.
• Engaged in dangerous or unlawful conduct.
• Violated these rules or the Terms of Service.
• Compromised or attempted to compromise the fairness, integrity, security, or operation of a challenge.

17. Safety

Participants must use reasonable judgment and attempt challenges only under conditions that are appropriate for their health, experience, surroundings, and abilities.

Participants must not trespass, violate laws, interfere with traffic, use unsafe equipment, endanger bystanders, or perform a challenge in a location that creates an unreasonable risk of harm.

KOTH may reject or remove any entry that depicts or encourages unsafe conduct, regardless of the participant's result.

18. Technical Problems

KOTH is not responsible for entries that are late, incomplete, corrupted, interrupted, misdirected, inaccessible, or not received because of internet failure, device failure, storage limitations, platform outages, software errors, or other technical problems.

Participants are responsible for allowing enough time to record, upload, and submit an entry before the deadline.

19. Modification, Suspension, or Cancellation

KOTH may modify, extend, postpone, suspend, or cancel a challenge when reasonably necessary because of fraud, cheating, technical failures, insufficient eligible entries, safety concerns, legal requirements, service outages, events beyond KOTH's reasonable control, or circumstances that prevent fair administration.

If a challenge is modified or canceled, KOTH may determine an appropriate outcome based on eligible entries received before the disruption or may decline to award a prize where permitted by law.

20. Administrative Decisions

KOTH's decisions concerning eligibility, verification, compliance, rankings, ties, disqualification, and prize administration are final to the fullest extent permitted by law.

A participant who believes an administrative error occurred may contact support@playkoth.app with supporting information.

21. Release and Limitation of Liability

To the fullest extent permitted by law, participants release KOTH and its owners, operators, administrators, contractors, service providers, and affiliates from claims arising from participation in a challenge or acceptance or use of a prize, except for liability that cannot legally be waived.

Participation in physical activity is voluntary, and participants assume the risks associated with their own challenge attempts as described in the Terms of Service.

22. Privacy

Information collected in connection with a challenge will be handled according to the KOTH Privacy Policy and may be used to verify entries, determine rankings, contact winners, deliver prizes, prevent fraud, and document competition results.

23. Changes to These Rules

KOTH may revise these Official Challenge Rules. The Last Updated date identifies the current version.

Material changes will not be applied retroactively in a manner that unfairly changes the announced winner-selection criteria for a challenge that has already closed, except when necessary to comply with law or address fraud or a material administrative error.
